Operation LEEDSTRUM: Offenders prosecuted and sentenced in Darwin
Operation LEEDSTRUM is an Australian Border Force (ABF) contribution supporting a whole-of-Government campaign to combat illegal foreign fishing in and around the Kimberley Marine Park (KMP) in Western Australia.
On 10 and 12 December 2023, Maritime Border Command (MBC) in partnership with the Australian Fisheries Management Authority (AFMA) intercepted two Indonesian vessels fishing illegally in waters within the KMP. Both fishing vessels were seized and destroyed at sea. The nine Indonesian crew were detained and conveyed to Darwin.
Following an investigation by AFMA, including forensic analysis of seized mobile devices, each of the nine crew were charged with offences against the Fisheries Management Act 1991 (Cth). The matters were heard at Darwin Local Court on 11 and 18 January 2024 with findings of guilt recorded in each case. The penalties imposed ranged from 12-month good behaviour bonds to imprisonment for up to ninety days. Two of the crew were wanted on outstanding warrants for unpaid fines relating to prior fisheries offences.
Operation LEEDSTRUM supports AFMA, ABF and Australian Defence Force’s commitment to increasing enforcement activity associated with illegal foreign fishing in the KMP. This includes the disposal of vessels, catch and fishing gear. Where appropriate, it also means apprehension of crews and prosecution for offences against Australian law.
Australian authorities continue to work closely with Indonesia in an ongoing capacity to address the issue. This includes delivery of public information campaigns to Indonesian communities, distribution of educational material, targeted social media campaigns and proactive engagement with Indonesian fishers.
